These Terms of Use ("Terms") govern access to and use of the Doctor On Call Healthcare Management System ("HMS").

By accessing or using the HMS, you acknowledge that you have read, understood, and agree to comply with these Terms, together with all applicable Doctor On Call policies and procedures.

If you do not agree to these Terms, you must not access or use the HMS.

Purpose of the HMS

The HMS is provided to support the delivery and administration of healthcare services. It enables authorized users to securely access and manage healthcare information necessary for clinical, operational, administrative, and related healthcare functions.

The HMS must only be used for authorized healthcare and business purposes.

Authorized Users

Access to the HMS is restricted to authorised users who have been granted access by Doctor On Call or an authorised participating healthcare facility.

Authorised users may include:

  • healthcare practitioners;
  • nurses;
  • pharmacists;
  • reception and administrative staff;
  • practice managers;
  • authorised Doctor On Call personnel; and
  • patients accessing approved patient-facing functionality.

Users must only access the HMS within the scope of their authorised role and responsibilities.

User Accounts

Each authorised user will be provided with an individual user account.

Users are responsible for:

  • maintaining the confidentiality of their login credentials;
  • ensuring that passwords are not shared with any other person;
  • immediately reporting any suspected unauthorised access or compromise of their account; and
  • ensuring that all activity performed using their account complies with these Terms.

Users are responsible for all activities carried out using their assigned credentials unless otherwise demonstrated.

Appropriate Use of the HMS

Users must use the HMS responsibly, ethically, and in accordance with applicable laws, professional obligations, and Doctor On Call policies.

Users must only access personal information where there is a legitimate clinical, operational, or business need.

Accessing personal information out of curiosity, for personal interest, or without appropriate authorisation is strictly prohibited.

Privacy and Confidentiality

Users acknowledge that the HMS contains confidential and sensitive personal information.

All users must:

  • maintain the confidentiality of all information accessed through the HMS;
  • access information only where authorised and necessary to perform their duties;
  • protect personal information from unauthorised disclosure;
  • comply with the Healthcare Management System Privacy Notice; and
  • comply with the Acceptable Use & Information Security Policy.

Unauthorised disclosure or misuse of confidential information may result in disciplinary action, termination of access, legal proceedings, or regulatory action.

System Availability

Doctor On Call will take reasonable steps to ensure the availability and reliability of the HMS.

However, uninterrupted access cannot be guaranteed. Access may be interrupted due to:

  • scheduled maintenance;
  • emergency maintenance;
  • security incidents;
  • software updates;
  • technical faults; or
  • circumstances beyond Doctor On Call's reasonable control.

Doctor On Call reserves the right to suspend access where necessary to protect the security, integrity, or availability of the HMS.

Intellectual Property

The HMS, including its software, design, documentation, trademarks, graphics, logos, workflows, and associated materials, is the intellectual property of Doctor On Call or its licensors.

Except where expressly authorised, users may not:

  • copy;
  • modify;
  • reverse engineer;
  • distribute;
  • reproduce;
  • sell;
  • licence; or
  • create derivative works from the HMS or its contents.

Audit and Monitoring

To protect the confidentiality, integrity, and availability of healthcare information, use of the HMS may be monitored.

The HMS maintains audit logs recording user activities, including but not limited to:

  • user authentication;
  • access to records;
  • creation and modification of information;
  • administrative actions; and
  • other security-relevant events.

Audit information may be reviewed for security, compliance, operational, investigative, or legal purposes.

Suspension and Termination of Access

Doctor On Call may suspend or terminate a user's access to the HMS where:

  • these Terms have been breached;
  • there is suspected unauthorised access or misuse;
  • access is no longer required;
  • employment or contractual arrangements have ended;
  • a participating healthcare facility requests removal of access; or
  • continued access presents a security or privacy risk.

Suspension or termination of access does not remove any continuing obligations relating to confidentiality or the protection of personal information.

Limitation of Liability

Doctor On Call will take reasonable measures to ensure the security and reliability of the HMS.

To the extent permitted by law, Doctor On Call shall not be liable for any loss or damage arising from:

  • temporary system unavailability;
  • technical failures;
  • interruptions to service;
  • unauthorised use resulting from a user's failure to protect their credentials; or
  • circumstances beyond Doctor On Call's reasonable control.

Nothing in these Terms excludes any liability that cannot lawfully be excluded under applicable law.

Changes to these terms

Doctor On Call may amend these Terms from time to time to reflect changes in legislation, technology, operational requirements, or business practices.

Where material changes are made, users may be required to acknowledge the updated Terms before continuing to use the HMS.

The latest version of these Terms will always be available through the HMS.

Governing Law

These Terms are governed by the laws of the Republic of Botswana.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Botswana, unless otherwise required by applicable law.
